Our Product Liability Group
The Product Liability Group is a national team of lawyers with expertise in all areas relating to product liability, including personal injury, economic loss, insurance coverage, product recall, defamation, drafting warning labels and exclusion of liability clauses and vetting user manuals. The Product Liability Group provides a seamless service across Canada in product liability cases arising in all provinces and territorial jurisdictions. Lawyers from all offices are assigned cases on consultation with the client, taking into account location, the nature of the case and the required level of experience and expertise, e.g. some of our lawyers are also engineers.
Some of our lawyers are members of more than one provincial bar and a call at any provincial bar for a specific case may be arranged when warranted. Local counsel may also be appointed to act under direction of Group lawyers.
Members of the Group have experience in defending class actions across Canada. As well, the Group has experience in defending national class action lawsuits where the courts of one province have certified the class to include participants residing outside of that province. The Product Liability Group can provide you with assistance in dealing with product litigation, government regulators in determining whether a product recall is indicated, your representation at a coroner's inquest or commission of inquiry, crisis management and in dealing with the media to preserve your brand name and product image. In cases of mass torts, we have experience in containing litigation and using innovative methods to obtain quick and advantageous settlements, including the use of alternative dispute resolution techniques, to defend the product and maintain its image.
We also have considerable experience in interpreting insurance policies and have represented corporations and insurers in insurance disputes arising out of insurance coverage questions. In addition to being retained by major corporations to defend their products, insurers routinely retain us to defend their insured's interests under liability polices.
