Background

Elissa Goodman has practiced in Borden Ladner Gervais’ Commercial Litigation Group (Toronto) since her call to the bar in July 2003.

Elissa attended law school at Queen’s University where she received honours for her work in constitutional law, civil procedure and family law. Elissa also holds a B.A. from Queen’s University with a major in English.

  • Elissa’s practice encompasses a range of civil litigation matters including:
    • Commercial Litigation.
    • Civil Litigation.
    • Commercial Fraud.
    • Banking Litigation.
    • Constitutional Law.
    • Injunctions and interlocutory remedies (including Anton Piller orders, Mareva injunctions and Certificates of Pending Litigation).

Professional Experience

  • Elissa has:
    • Appeared before the Supreme Court of Canada, Ontario Court of Appeal, Ontario Divisional Court, Superior Court of Justice and the Federal Court of Canada.
    • Represented major U.S. and Canadian television satellite broadcasters in anti-piracy actions.
    • Represented major Canadian financial institutions in a variety of banking and litigation matters, including lender liability issues, security enforcement, and bills of exchange litigation.
    • Acted as plaintiff’s counsel and independent supervising solicitor in the execution of Anton Piller Orders.
    • Participated in drafting 'model' Anton Piller and Mareva orders for the Superior Court of Justice (Commercial List).
    • Managed complex, large-scale technologically-dependant litigation files.

Professional Achievements

  • Author of 'Failure to Protect Privilege May Lead to Removal of Counsel', Commercial Litigation (2004) Volume X, No. 3, p. 526.
  • Co-author of 'Mastering the Art of Character, Credibility and Similar Fact Evidence,' presented at Advanced Forum on Civil Procedure and Evidence (Canadian Institute, 2003).
  • Recipient of Department of Justice/Canadian Bar Association National Essay Contest 2002 for paper entitled Section 7 of the Charter and Social Interest Justification.
  • Recipient of the C. Douglas MacLeod Memorial Scholarship 2001-2002 (for academic success in the area of constitutional law).
  • Recipient of David Sabbath Prize in Advanced Civil Procedure (2002), P.E. Newbury Prize in Family Law (2001), and David Sabbath Prize in Constitutional Law (2000).
  • Recipient of Wilson Moot Competition Factum and Oralist Second Place Award (2001).
